Appeal

In trial court , case value was 10 lac. Judgement was made on 11.11.09. Instead of appealing in session judge, effected party filed appeal in Lhc on 15.2.10.
In Lhc i said it is wrong forum as the value is 10 lac. The appellant withdrawn the appeal after 5.5 years and filed it in appellant court. Can you advise me, where am i standing.
