confiscation of biana

My case for the confiscation of biana is in court, on the other hand, my opponent lawyer taking dates without the valid reason, the biana was taken by me from real estate agent pad who want purchase plot from me but unable to pay me remaining amount but within the stipulated period. On my case he submitted his suit on the court that I m not providing documents which are false statement, I have mob msgs wherein I requested him to pay me amount but he never responded. Is mob msgs can be a proof to be considered in court? Please advise what plea I take to confiscation. Is my case is valid? Kaleem
