Question :

Dear Sir: My right knee was replaced at Liaquat National Hospital in Karachi and it turned out badly. I requested a copy my medical records in writing which they refused to release to me the patient. I am looking for the following:
1. Precedents from the superior and supreme court that healthcare institution (custodian of records) or the attending surgeon can not refuse to supply the patient a copy of his medical records. Some thing that states clearly and catagorically that patient has a right to access his medical records.
2. Can we learn how many cases are outstanding in Pakistani courts against
a. Liaquat National Hospital and
b. Dr. Mohammad Zaki Idrees (Orthopedic specialist at LNH)
c. Any statistical information about number and types of cases outstanding or adjudicated against LNH or Dr. Zaki Idrees.
Kindly let me know what will be your fee for this research. Keeping in mind I am a retiree with limited resources. I shall be greatly obliged for your help.

Answer:

  1. you should know that in Pakistan now all institutions are duty-bound to provide full access information to a concern person. you may claim the information at Karachi under Sindh Transparency and Right to Information Act, 2016.

you have also the right to initiate criminal and civil proceedings against the doctor/hospital for their professional negligence.

regarding getting full data about their cases ll be a difficult task but it’s not impossible. we can manage it for you.
