Hi guys, my father paid a travel agency 94000 rs a year ago for an airline ticket via cheque in the agency’s name. Unfortunately his plans got delayed and didn’t book a date, when he went to book a date and collect his ticket the agency told him that the person he had given the money ran away and said the money you gave was a personal loan to the travel agent. My father then had to book another ticket for his flight. My question is can I get my 94,000 rs back or is our hard earned money been stolen by the agency ? They are saying that you don’t have a receipt for the ticket so we can’t give you back the money, but I have copies of the cheque that were given to the agency through which they have drawn the money. I really need help, I am a student and need the money for my university fees. It’s 2018, how can a corporation commit this type of fraud and get away with it ?

your conduct doesn’t show that it was hard earned money as you already wasted one year to take any legal action. If payment was made in the name of Company through cheque then it sufficient to prove your claim against the company.
you may file a complaint a before police for this fraud or may also file a recovery suit against the company before the Civil court. You may also file a complaint with consumer court if it is within time.

Aoa brother, I saw your comment. The case Is not a year old, my father paid the travel agency a year ago but didn’t book a ticket due to personal reasons and health. When he went to confirm the date last month the agency told us that the agent whom we paid the money settled the cheque as a personal loan. We argued that the cheque is in the agency’s name, but they said that you have no receipt for the ticket so we can’t pay you back the money. My question is I have copies of the cheque in the agency’s name, but don’t have receipt for the ticket because my father trusted the agent since he has been buying tickets from them since 6 years, is that enough evidence against them to get our money back ? And should we first go to the police to file complain or go to court ? And my father is currently not in Pakistan so can I file the police complaint or is it necessary that my father can only file as the cheque given was in his name. I really need help, my university is about to start and I am short on fees
