How to do Court Marriage

court marriage

Concept of Marriage in Pakistan: The concept of court marriage in Pakistan differs from Western countries, granting every eligible male and female the right to engage in a marriage contract.

The Constitution of Pakistan safeguards family rights and the right to celebrate marriages, but it explicitly prohibits same-sex marriages.

Step-by-Step Procedure:

1. Advance Engagement: Contact us at least 2 days prior, confirm your intention, and make an advance payment. We will then prepare your documents for the court marriage.

2. Office Visit for Court Marriage: The couple needs to visit our office at the designated time. We ensure excellent services with utmost privacy, providing a Nikah Khawan/ Nikah Registrar, Stamp vendor, and Notary Public or Oath commissioner at our office.

3. Legal Consultation: A seasoned Family Lawyer will be available for consultation. Feel free to engage with the lawyer to discuss matters such as determining the Dower/Haq Mehar, ensuring spousal maintenance, addressing conditions outlined in the Nikah Nama columns, and understanding various other rights.

4. Nikah Solemnization and Marriage Registration: The Nikah Khawan will solemnize the Nikah according to Islamic tradition, and the marriage will be registered accordingly. You can also request a computerized Nadra Marriage certificate.

5. Affidavit of Bride: A duly stamped affidavit for the bride will be meticulously prepared, and the bride will sign it before the Oath Commissioner. Following her affirmation during the marriage process, either the Oath Commissioner or Notary Public will subsequently attest the same. This affidavit serves as a tangible representation of her consent, confirming her voluntary commitment to the marriage undertaken of her own free will.

6. Statement before Court: To protect the marriage and prevent any potential action from the parents’ side, the bride’s statement will be recorded before the Session Judge/Justice of Peace through a writ petition filed before the Justice of Peace/Session Court, if so required.

Court Marriage Procedure for Christians:

The court marriage procedure for Christians mirrors the aforementioned steps, with the only distinction being the incorporation of the Nikah ceremony in accordance with Christian rituals, officiated by a Padri. However, the remaining aspects of the marriage procedure remain unchanged, ensuring a consistent process for individuals of different faiths.Court Marriage
