Question :

Assalam o Alaikum sir!
Sir agar jirga ne custody of minor boy (7 years old) father ko di ho, 1 year guzarne k bad agar orat court mei dobara custody ka case file kare to kia adalat custody change karegi?? Jirga ka faisla written mei moujood ha mere pas… mai ne orat ko 7 lac rupees bachay ka kharcha bhi ada kia tha jirga mein.

    JIRGA has no such rights, custody of minor ll be decided as per law, wherein welfare of minor is a paramount consideration. However, in my opinion, you have a good arguable case now as JIRGA decision and Muhammad Law supports you and also the minor preference should be considered in your case.
