Hi there, There is an issue in my birth certificate, my place of birth in the birth register at union council and that on the birth certificate are different. I’m currently living in Germany and they say the birth certificate is authentic but not legally valid. Now it’s required from me to delete the entry and birth certificate and the council issue me a new one. MY QUESTION IS; As I’m currently not in Pakistan, can my father process this all without Power of Attorney? And will we need a court decree for this or just an affidavit? What’s the procedure to follow? Please guide:
Answer:
Yes, you will need a court decree to correct or delete the entry in the birth record, as such rectifications cannot be made merely on the basis of an affidavit. Your father or any trusted person may be appointed as your attorney through a duly attested Power of Attorney to handle the court proceedings and related work at the Union Council on your behalf.
In summary:
A court decree is required.
Your father can act as your attorney with a properly executed Power of Attorney.
The Union Council will issue a new corrected birth certificate once the decree is presented
