Question :

I m Malaysian. I m in Malaysia. My husband is Pakistani in Shadbagh Lahore Pakistan. We want to register our marriage in Pakistan. We got married in Malaysia. I have all document attested at the Pakistani embassy in Malaysia already. But UC said I must go there to sign the application form. Is this true?

Answer:

Since you are a Malaysian national residing in Malaysia and your marriage was solemnized in Malaysia, your personal appearance in Pakistan is not necessarily required merely because the Union Council has asked you to sign the application form.

As your marriage documents have already been attested by the Pakistani Embassy in Malaysia, your husband should submit the complete documents to the concerned Union Council in Shadbagh, Lahore, and request registration of the marriage on that basis.

If the Union Council insists that you must appear in person, ask them to identify the specific legal provision or written rule requiring your personal attendance. You may also ask whether they will accept an application signed and attested by you through the Pakistani Embassy, or a properly executed Special Power of Attorney authorising your husband or another representative to complete the registration formalities.

Legal advice: Do not travel to Pakistan solely on the basis of an oral demand. First obtain the Union Council’s written requirements and have them reviewed by a Pakistani family-law advocate.
