Question:
I need Khula before Rukhsati. Is this possible in Pakistan?
Answer :
Yes, Khula is legally possible in Pakistan even if Rukhsati has not taken place. If the Nikah has been solemnized and registered, a wife may seek dissolution of marriage through the Family Court, even if the spouses have never lived together or consummated the marriage.
If the matter proceeds through Khula, the court may also consider the question of Haq Mehr (dower), including whether any amount is recoverable or refundable under the applicable law and the facts of the case. The absence of Rukhsati does not, by itself, prevent a wife from seeking Khula.
