Assalam Alaykum,
I got married in Pakistan via videoconference, my wife (who is a Pakistani citizen) was in Pakistan while I (I am a french citizen but from Pakistani background) was in France.
The marriage was legally celebrated and registered in Pakistan. However, when I tried to make the marriage recognised in France, the public prosecutor refused because the French Civil Code requires the french citizen who is getting married abroad to be physically present in the country of celebration, which is not the case as I was in France and celebrated via videoconference.
Could you please let me know if there is any solution under Pakistani law? French lawyers recommend divorcing and then re-marry the same person. However, according to Islamic law, this is not possible as I need to get married to someone else first and then divorce and then re-marry my wife. This is clearly not a solution for me.
Your guidance will be highly appreciated.
Many thanks.
Yours sincerely,
Haqnawaz Khan
