(b) imprisonment which may extend to seven years and shall also be liable to fine, if the
quantity of the narcotic drug, psychotropic
substance or controlled substance exceeds
one hundred grams but does not exceed on kilogram;
(c) death or imprisonment for life, or imprisonment for a term which may extend to
fourteen years and shall also be liable to fi
ne which may be up to one million rupees, if
the quantity of narcotic drug, psychotropic substance or controlled substance exceeds the
limits specified in clause (b):
Provided that if the quantity exceeds ten k
ilograms the punishment shall not be less than
imprisonment for life.

That under the Control of Narcotic Substances Act, 1997 (XXV of 1997), the nature and extent of punishment is strictly dependent upon the quantity of the narcotic drug, psychotropic substance or controlled substance allegedly recovered. Where the quantity exceeds one hundred grams but does not exceed one kilogram, the case falls within the ambit of section 9(b) of the Act, which provides punishment of imprisonment that may extend to seven years along with fine. However, where the quantity exceeds one kilogram, the offence attracts section 9(c) of the Act, which prescribes the punishment of death or imprisonment for life, or imprisonment which may extend to fourteen years, along with fine, and in cases where the quantity exceeds ten kilograms, the minimum punishment shall be imprisonment for life.
