Asalaam o alekum, sir, hum 5 sisters aur 3 brothers hain ,humarey walid mohtram ka intakal ko 10 sal hoye hain, him property ki takseem chahte hain lekin ,1 bhai nahi chahte ,1 makan walid sahab ne documents nahi banway they,us per qabza kia hua hai,3 makan ke document apne pas rakhey huway hain, sawal ye ha court kese takseem ker Ke de sakti hai? Kia procedure hai? Thanks

    Please file a suit for declaration to get the decree to delare as owner and property anf then you may file a suit for partition before civil court.
    Court sahll partitioned the proeprty as per share.
