lets suppose a firm or business entity ( not a pvt limited ) located in karachi, employees between 10 – 30 employees,looking for below answers according to Labour Laws of Pakistan:

1- How many month company can keep a employee on probation?
2- can any of the both parties (employer & employee) terminate the contract
before probation?
3- How much notice period is required from both side, in case of
termination before probation period?
4- How many hours a day and week is legal to ask the employees for work by
considering that its an business entity.
5- please define the meal breaks also (e.g 8 hours work 1 hour meal break =
9 hours)
5- Is this business entity is bound to provide the annual leaves, please
define according to labour law?
6- How many sick leaves an employee is entitle for in one year as per
labour law?

 

Answer:

  1. 1- How many month company can keep a employee on probation?

    Ans; Period of probation is three months.

    2- can any of the both parties (employer & employee) terminate the contract before probation?

    Ans: yes any party has the right. No temporary workman or probationer , shall be entitled to any notice if his services are terminated by the employer, nor shall any such workman be required to give any notice or pay any wages in lieu thereof to the employer if he leaves employment of his own accord.
    3- How much notice period is required from both side, in case of termination before probation period?

    Ans; any time , as stated in reply of question No.2.
    4- How many hours a day and week is legal to ask the employees for work by considering that its an business entity.

    Ans; 8 Hours

    5- please define the meal breaks also (e.g 8 hours work 1 hour meal break = 9 hours)

    Ans; 8 hours a day including lunch break.

    5- Is this business entity is bound to provide the annual leaves, please define according to labour law?

    Ans; Yes, Sick leave for seven days. Casual Leave for seven days and Annual Leave for 14 days after completion of 12 months service.
    6- How many sick leaves an employee is entitle for in one year as per labour law?

    Ans: Sick leave for seven days.
